3. DATENERFASSUNG BEIM BESUCH UNSERER WEBSITE
3.1 Hosting
Unsere Website wird bei Cloudflare Pages gehostet. Vertragspartner und Auftragsverarbeiter ist Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA. Beim Aufruf der Website werden automatisch technische Zugriffsdaten (u. a. IP-Adresse, Datum/Uhrzeit, aufgerufene Seite, Browsertyp) in sogenannten Server-Logfiles verarbeitet.
Rechtsgrundlage ist Ihre Einwilligung (Art. 6 Abs. 1 lit. a DSGVO).
4.3 Sprachsteuerung / Wake-Word („Hey Shreddy“)

3. DATA COLLECTION WHEN VISITING OUR WEBSITE
3.1 Hosting
Our website is hosted on Cloudflare Pages. Our contracting party and processor is Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA. When you visit the website, technical access data (e.g. IP address, date/time, page requested, browser type) is automatically processed in server log files. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in technically error-free operation). As Cloudflare is based in the US, personal data may be transferred to the US in this context. Such transfers are based on the EU Standard Contractual Clauses together with supplementary measures, incorporated by way of the Cloudflare Data Processing Addendum.
3.2 Cookies and Consent
Our website sets no cookies for statistical or marketing purposes and loads no third-party content requiring consent. Fonts, images and all other components of the site are served from our own website; no content is retrieved from Google Fonts or comparable third-party services. We therefore do not use a cookie banner. Should we use cookies or services requiring consent in the future, they will only be set with your prior, voluntary consent (§ 25(1) TDDDG, Art. 6(1)(a) GDPR), and this Privacy Policy will be updated accordingly.
3.3 Beta Signup / Waitlist Form
If you sign up via our beta/waitlist form, we collect the email address you voluntarily provide (and any other information you choose to submit). Signing up requires a separate, not pre-ticked checkbox by which you expressly agree that we may contact you about the beta phase and the app launch by email. The purpose of this processing is to contact you as described above (invitations, status updates, product announcements). The legal basis is your consent (Art. 6(1)(a) GDPR), given by ticking the checkbox and submitting the form. As proof of your consent, we store the exact wording of the consent statement together with its version number, the time (UTC) and the language in which it was given. Your data will be stored until the beta phase concludes or until you withdraw your consent, and will then be deleted or anonymized within six months. You may withdraw your consent at any time with effect for the future — by emailing info@xshred.de, by replying to one of our emails, or via an unsubscribe link where provided.
3.4 Contact Form
Our contact form lets you send us your name (optional), your email address and a message. We process this information solely in order to answer your enquiry. The legal basis is Art. 6(1)(b) GDPR where the enquiry relates to entering into or performing a contract, and otherwise Art. 6(1)(f) GDPR (legitimate interest in responding to enquiries).
3.5 Where Form Data Is Stored
The information submitted through both forms (beta signup and contact) is stored in a database operated by our host Cloudflare (Cloudflare D1, database name “xshred-web-eu”). This database was created with the “EU” jurisdiction and is therefore legally confined to the European Union. In addition to your entries, we store the country of origin determined by Cloudflare and, for the beta signup, the language identifier transmitted by your browser. Your IP address is not stored in this database in plain text: to protect against abuse (bots, automated mass submissions) we form a hash from your IP address and a secret value known only to us, from which the IP address cannot be reconstructed. This hash is stored together with a timestamp to detect more than five form submissions per hour from the same address, is automatically deleted after about one hour, and is never linked to an email address. The legal basis for this is Art. 6(1)(f) GDPR (legitimate interest in a functioning form free from abuse).
4. DATA PROCESSING WITHIN THE X-SHRED APP
The following sections apply to use of the X-Shred app (iOS/Android) and supplement the website-related information above.
4.1 GPS Tracking
X-Shred offers a GPS tracking feature to record your ski/snowboard runs (position recorded at approx. 5-second intervals). This feature is opt-in, meaning it is only activated with your express consent, and can be disabled at any time in the app settings. Location data is primarily processed locally on your device. The legal basis is your consent (Art. 6(1)(a) GDPR).
As soon as an internet connection is available, the recorded points (latitude and longitude, speed, altitude, time and activity type) are stored in your user account in our database (Google Firebase) and linked to your user ID. The purpose of this storage: we use it to show you your own ski lines on the map, including for past days and on a new device. Only you can see these points. There is no anonymized or shared analysis together with other users' data. The data remains stored for as long as your account exists and is deleted when the account is deleted (see Section 4.6).
4.2 Live Location Sharing With Friends
X-Shred optionally offers a feature to share your live location with friends you have selected and expressly approved. This feature is disabled by default (opt-in) and can be stopped at any time. Your live location is never shared with anyone other than your approved friends, nor with any third parties outside the app. The legal basis is your consent (Art. 6(1)(a) GDPR).
4.3 Voice Control / Wake Word (“Hey Shreddy”)
The wake word (“Hey Shreddy”) is detected on your device. Voice commands are converted to text by your operating system's speech recognition; the app requests recognition on the device (“on-device”). On iOS, recognition stops if your device or language has no model for it; it does not fall back to a server. On Android, on-device recognition is only a preference: before Android 12, or without an installed offline language pack, your command may be processed by your device's speech recognition service (usually Google) without the app indicating this. We ourselves do not upload audio recordings or the recognized command text to our servers; the command is interpreted within the app. The legal basis is Art. 6(1)(b) GDPR (performance of contract, as this is a core app function) or (f) (legitimate interest in functionality).
We do not store command texts, not even briefly. The technical log file on your device (at most 1 MiB) does not contain any spoken wording in the released app.
4.4 Account Creation / Sign-In
Certain features require a user account. You can sign in with email address and password, with Google or with Apple (provided through Firebase Authentication, Google Ireland Ltd./Google LLC). Data required for sign-in (e.g. email address, display name) is processed. In addition, we create a public profile (display name, profile picture if you upload one, and your X-Shred ID). Other signed-in users can retrieve this profile through search, by QR code or by link. Only you and your confirmed friends can read your email address. The legal basis is Art. 6(1)(b) GDPR.
4.5 Emails About Account Deletion
When you mark your account for deletion and when it has been deleted, we send a confirmation email to your account's address (sender info@xshred.de); if you choose “Delete immediately and permanently”, the first one is omitted. We do not store your address separately for this: it is read from your account when the email is sent. Sending runs through Google Workspace. A copy of the confirmation email remains in our mailbox info@xshred.de as proof that the deletion was carried out. The legal basis for sending is Art. 6(1)(b) GDPR (contract); for the retained copy Art. 6(1)(c) GDPR (legal obligation, proof of compliance with Art. 17 GDPR) and (f) GDPR (legitimate interest in proving the deletion).
4.6 Account Deletion
You can delete your account in the app. It is then marked for deletion, you are signed out, and your public profile can no longer be retrieved by others. For 30 days you can cancel the deletion by signing in again. After that, a deletion run that executes every 6 hours deletes your account; deletion is therefore completed 30 days plus up to 6 hours after your request. If you choose “Delete immediately and permanently”, the waiting period does not apply. Deleted are your account and profile, your location and recording data including the heatmap points, friendships and requests, blocks, notifications, push tokens, and profile pictures and pictures of your own groups. Your own groups and meeting points in which others take part are handed over to the person who has been in them longest; you are removed from other people's groups and meeting points. Reports (Section 4.7) that you have submitted or that concern you are not deleted with the account but 90 days after receipt. The legal basis for account deletion is Art. 6(1)(b) GDPR (contract) or Art. 6(1)(c) GDPR (legal obligation under Art. 17 GDPR).
4.7 Blocking and Reporting
You can block and report other users. When you block someone, we store your ID, the blocked person's ID, their display name (for your “Blocked users” list) and the time. A blocked account is hidden from search. The blocked person can technically read the entry; the app does not display it. A block remains until you lift it or an account is deleted. When you report someone, we store your ID, the reported person's ID, the reason (harassment, name or picture, spam, other), the place in the app from which you reported, the time and, if you write one, a free text of at most 1,000 characters. Reports cannot be read by other users. For every report we automatically send an email to info@xshred.de containing the report ID, reason, place, time, both IDs and whether a free text exists, but not its content; this email remains in the mailbox info@xshred.de. Reported cases are deleted from the database 90 days after the report is received, regardless of any account deletion (see Section 4.6). The legal basis for blocking and reporting is Art. 6(1)(f) GDPR (legitimate interest in protecting users from abuse).
4.8 Notifications (Push)
If you consent to notifications, we store your device's push token, the platform (iOS or Android), the device language and the time of the last update, and send notifications through it (e.g. about friend requests and meeting points) via Firebase Cloud Messaging (Google). A notification about a friend request contains the sender's display name. If you withdraw your consent, the token is removed. The legal basis is your consent (Art. 6(1)(a) GDPR).
4.9 Crash Reports and Usage Analytics
Crash reports (Firebase Crashlytics) and usage analytics (Firebase Analytics) are switched off until you consent to each; these are separate decisions, and a withdrawal takes effect immediately and persists. With crash reports, your user ID is sent as a pseudonym so that a crash can be linked to your account, never your email address or name. The legal basis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG).
4.10 Abuse Protection (App Check)
When it starts, the app confirms to our server, via Apple App Attest (iOS) or Google Play Integrity (Android), that it is a genuine, unmodified app. In doing so, a device attestation is transmitted to Apple or Google; no content of your use is transmitted. The purpose is protection against abusive access and the costs it causes. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in the security and abuse-free operation of our services).
5. RECIPIENTS AND PROCESSORS
To provide our services, we use the following processors and service providers, among others: Cloudflare, Inc., 101 Townsend Street, San Francisco, CA 94107, USA (website hosting and the database behind our forms), Google Firebase/Google Cloud (authentication, database, backend functions, notifications, crash reports and usage analytics of the app), Google Workspace (sending account emails, receiving reports), Mapbox (map rendering in the app). Data processing agreements under Art. 28 GDPR are in place with these providers, based on their respective standard data processing agreements; in the case of Cloudflare this is the Cloudflare Data Processing Addendum. Where personal data is transferred to the US, this is done on the basis of the EU Standard Contractual Clauses together with supplementary measures or, where the respective provider is certified, the EU-US Data Privacy Framework. We do not use a translation service: the German and English versions of this website are maintained by us.
6. RETENTION PERIOD
We retain personal data only for as long as necessary for the respective purposes or as required by statutory retention obligations (e.g. commercial and tax law retention periods for invoicing data, up to ten years). After a deletion request, your account and the associated data are deleted after 30 days (cancellation period) and up to 6 hours, or without a waiting period if you delete immediately, unless a statutory retention obligation applies (details and exceptions: Section 4.6). Specific retention periods by data category: for GPS recordings see Section 4.1, for account emails Section 4.5, for reports (90 days) and blocks Section 4.7, for beta signup see Section 3.3.
7. NO AUTOMATED DECISION-MAKING
No automated decision-making within the meaning of Art. 22 GDPR (including profiling with legal effect) takes place.
8. MINORS
Our service is not specifically directed at children under the age of 16. Use of the service requires a minimum age of 16. When registering, you confirm that you are at least 16 years old.
9. CHANGES TO THIS PRIVACY POLICY
We reserve the right to amend this privacy policy to reflect changes in the law or in our service. The version published on the website at the time of your visit shall apply.
